In an important victory for California gun owners, the Fresno Superior Court ruled today that California’s new ammunition regulation law is unconstitutional, and blocked further enforcement. The law, passed last year as AB 962, would have banned mail order ammunition sales and required all purchases of so called “handgun ammunition” to be registered. In an unwritten ruling from the bench, Judge Jeffrey Hamilton found the law unconstitutionally vague on its face and issued an injunction against its enforcement. For now, at least, mail order ammunition sales to California residents can continue, and ammunition sales need not be registered under the law.
There is more to the above article, but in the spirit of cut and paste less, for some readers, I opted for this snippet.
My thoughts; At least this is a step in the direction of Constitutionally correct legislation. This ban was nothing but a politico move and DID NOTHING to keep us safe. The ammunition ban would not have prevented criminals from purchasing or importing ammo in California. It would have put a big problem on the backs of legal gun owners who need practice time to keep their proficiency up. This bill signed by Arnold was in effect a joke as even the Dept of justice (DOJ) have not even attempted to figure out a way to keep the information of sales or apply it to weapon. A government afraid of private gun ownership is a government to be worried about. The second amendment gave us rights, the Liberal Progressive socialist are hell bent in taking them away. If you have time call your local Calif. Assembly person or Senator and tell them to wake up once more the peoples will, and stop imposing these draconian laws that usurp out given rights. This is not over, not by a long shot!
At least the price will come back down!
“A government afraid of private gun ownership is a government to be worried about.”
Yes, thanks for writing Mr. Ey.
And Quentin, thanks for sticking with the RDA committee last night, we watched from home. We’ve got to do something about the way these meetings are agendized, not sure what.
I heard this topic discussed last night on KGO. AS you can imagine a variety of thoughts on the subject.
I have a question for anyone here.
We do have to have a backround check in order to purchase a gun, I think a 10 day waiting period or is it 15?,
At the time of purchase why not give the buyer an “approval” card with a specific number, maybe the size of a drivers license, when it is necessary to purchase ammunition just show the card to eliminate more intrusion.
Mail order can also use the number along with a major credit card, no cash or checks.
Would that idea work?
NO “bad guy” is going to go through this malarky, all the new rules do is put Mr. Average Joe through exteded paces.
If it becomnes necessary to seek a compromise, having an out of state order number is a great idea Harriet. I love the humble brilliance that comes from our PS readers!
ATTENTION STEVE: Steve, could you just mention this to Dan Logue and get his take? The only downside I can see is that sellers would have to make room to write down the ID number and they would have to have some way of verifying it was legit.
The problem as I see it is the left is looking for perfection when it comes to regulating both ammo and firearms. Instead what they do only offends and suppresses the decent, honest people. The ruling was fair and just.
Jack,
I checked on this today but not a lot of information. We’re pretty sure the authors will appeal the decision. It’s also unclear what effect the decision will have at this point.
Bottom line is it’s a bad law and an infringement on our 2nd Amendment Rights that Dan Logue opposed loudly and proudly on the Assembly floor. To this day I don’t get what part of “from my cold dead fingers” the democrat party doesn’t get. We say leftists and liberals on this site, but all the anti-gun bills in California are sponsored by DEMOCRATS.

I would love to see dems and reps adopt a policy that says you must select 2 or 3 priorities to work on during the odd numbered years in political office, and nothing else. Such as the Budget, Taxation and Education. When they solves these problems then they can use the rest of the year to work on special interests projects that will line their pockets like they always do, but at least the people will have something for their money…instead of the stupidity we get now like the ammo law. I don’t think it’s too much to ask of them do you? Just do what we want for a few months every other year – not what they want?
Good info. Lucky me I ran across your site by accident (stumbleupon).
I’ve saved as a favorite for later!
