One of the officers on trial in the Freddie Gray case, the van driver, sits in a much better position today after the judge in his case discovered the prosecution withheld evidence that would be beneficial to the officer.
Judge Barrie Williams was “visibly angry” upon discovering that testimony from a key eyewitness was withheld. That would be the official taped account of Donta Allen who was picked up for transport after Gray. He told police his ride in the van was “smooth” and that he heard Gray moving around in the van and “banging against the partition.” His testimony included the following:
Allen told police that it sounded like Gray “was banging his head against the metal, like he was trying to knock himself out or something.”
Allen said he thought there was “a dope fiend” on the other side of the divider purposefully banging his head, four or five times. “It was like – he wasn’t doing it hard and [expletive], but he was definitely banging himself in the head. I know he was.”
The judge didn’t dismiss the charges but this evidence will certainly play out in the defendants favor. It could also impact the trials of other officers awaiting trial.
It’s incredible how far the prosecuting attorneys would go to destroy the lives of police officers. One has to wonder if the motivation was to add fuel to the notion that police officers always treat blacks unfairly. Politics has no place in our justice system. While it is true that prisoners should be belted during transport it is also true that the prisoner may very well have been responsible for damage that cost him his life. The bottom line is all of the available evidence should be disclosed.If we are going to live under an equal justice system the highest standards of conduct must prevail in court.

That said how does a man in handcuffs break his spine in the back of a police vehicle? The police loaded him in and put a seatbelt on him right? NOT!
The police are guilty. But then again you know more in Chico than I saw in Baltimore right?

One of the early stories on Gray brought out the fact that he had a history of injuring himself then making a claim against an insurance company, and that his most recent claim was for a back injury. This time he went too far.
Gonna be an interesting malicious prosecution case against Mosby & Co.
