Obama to Announce, Keep Your Plan…for a Year”

Posted by Tina

Woo hoo! The President will announce this morning that you can keep that old substandard plan for a year and your insurance company has to let you know about it. Oh boy, way to make the mess a little more messy. I wonder what will happen next year when the business plans are expired for being substandard (remember they got a years waiver)? We’ll go through this all over again.

I heard from my CPA. She sends a letter out each year advising her clients of changes in tax law that will impact their tax return. she says she has no idea what to put in the letter. This year the law has changed so many times there is no certainty.

Democrats and Republicans are still considering “fixes” for the ACA. But there are many lawmakers and journalists who continue to think there is no way to fix Obamacare,

Scrap it!

  1. Peggy says:

Wonder what he’ll propose for the 5 plus million who have already had their insurance cancelled? He can’t make them good again.

Former Federal Prosecutor Andrew McCarthy says Obama is guilty of “serial fraud.”

    http://www.nationalreview.com/article/363538/obamas-massive-fraud-andrew-c-mccarthy

  2. Peggy says:

Also, if he does propose this one year delay won’t it align it with the business delay which is just before the 2014 election? Yahoooo!!!

  3. Libby says:

Tina, you need to clean out those cookies!

Yesterday on NPR, during a report on the ACA enrollment numbers, there was a little snippet from one of these “insurance” companies actually formed (aka capitalized) to operate on the Maryland exchange which company is, as you might imagine, quite worried about the anemic numbers.

I’m worried for anybody who actually signs up with such a “provider.”

  4. More Common Sense says:

According to the constitution President Obama has no authority to change a law passed by congress. All previous changes to the ACA (including the delay for business) and this change are illegal! The only thing Obama has done in his tenure as president is ignore the highest law of the land, the Constitution, and establish himself as the first American dictator! He should be impeached!

  5. Tina says:

McCarthy makes the legal case for sure. From the article:

If you like your health-care plan, you will be able to keep your health-care plan. Period.” How serious was this lie, repeated by Barack Obama with such beguiling regularity? Well, how would the Justice Department be dealing with it if it had been uttered by, say, the president of an insurance company rather than the president of the United States?

Fraud is a serious federal felony, usually punishable by up to 20 years’ imprisonment — with every repetition of a fraudulent communication chargeable as a separate crime. In computing sentences, federal sentencing guidelines factor in such considerations as the dollar value of the fraud, the number of victims, and the degree to which the offender’s treachery breaches any special fiduciary duties he owes. Cases of multi-million-dollar corporate frauds — to say nothing of multi-billion-dollar, Bernie Madoff–level scams that nevertheless pale beside Obamacare’s dimensions — often result in terms amounting to decades in the slammer.

Justice Department guidelines, set forth in the U.S. Attorneys Manual, recommend prosecution for fraud in situations involving “any scheme which in its nature is directed to defrauding a class of persons, or the general public, with a substantial pattern of conduct.” So, for example, if a schemer were intentionally to deceive all Americans, or a class of Americans (e.g., people who had health insurance purchased on the individual market), by repeating numerous times — over the airwaves, in mailings, and in electronic announcements — an assertion the schemer knew to be false and misleading, that would constitute an actionable fraud — particularly if the statements induced the victims to take action to their detriment, or lulled the victims into a false sense of security.

The law is very clear. And he’s right; an insurance president would be facing jail time…the public would be outraged and satisfied with the decision.

I will repeat something that I believe to be true. The black man will never be completely equal as long as he is untouchable when it comes to failings…particularly failings that involve the law. The fact that this man is president muddies those legal waters. If the American people were interested in the equality and the rule of law they would be calling for impeachment.

    Politically…ain’t going to happen.

  6. Tina says:

Can you imagine the cost to these insurance companies to drop all of these plans in the first place? And now they will be pressured to re-institute them causing even more expense! This is so incredibly Jr. High.

  7. Pie Geuvara says:

I am outraged! OUTRAGED I TELL YOU! This is signed and sealed legislation! It is THE LAW! It is a done deal! I will not stand for this heinous attack on the legitimate legislative process, usurpation of the ACA, and negation of the constitution by the executive branch! You can’t pick and choose and make things up along the way! This is UN-AMERICAN!

Oh wait, silly me. If you are Obama you can do anything you like. Just hand Sebelius her marching orders and she legislate by selective enforcement and re-writing regulations.

Obama today did not announce his fix for the ACA, he announced his fix for Democrats up for reelection. You gotta admire that transparent maneuver,

  8. Peggy says:

Obama’s fix has made ObamaCare even worse. By extending the individual mandate he has allowed the young and healthy to not sign up, therefore, will not be paying for the old and sick which was necessary to fund it.

This can only result in much higher premiums for everyone who does pay through the exchanges and with private insurance companies. And don’t forget the increased state taxes that will hit for all of the new Medicaid patients.

Jr. high Tina? This is prekindergarten. A four year old knows they have to play nice with everyone in the class, they can’t have everything their way and they can’t yell, “Mine..mine…mine” and tell lies all of the time without wondering why they don’t have any friends.

Remember the ACA bill was done behind closed doors? There were TV cameras in the halls showing the Democrats coming out of LOCKED doors and the Republicans complaining they were being locked out and their contributions were being rejected.

Like I said before I hope every Republican rejects every bill the Democrats present and force them to repeal ObamaCare. They should adopt Harry Reid’s attitude of, “Why would I do that.” when asked if he would help kids dying of cancer. They made this mess, let them pay for it.

  9. Peggy says:

Also, state insurance commissioners have the power to decide if their state will participate with this fix. They’re now screaming about the mess Obama just presented them to remedy in just six weeks. Wonder what the ratio of red and blue states will even make the effort?

  10. Peggy says:

Sorry for all of the post, but this was just too good not to share.

    Piers Morgan ✔ @piersmorgan

Considerably more Americans signed a petition to have me deported, than enrolled for Obamacare. I’d start panicking, Mr President…

  11. Libby says:

“According to the constitution President Obama has no authority to change a law passed by congress.”

But it’s perfectly cool to make adjustments re the implementation of any regulation in the law. In fact, failing to implement and or fund laws we don’t like has long been a speciality of Republican administrations. I don’t think you’re in a position to make a fuss.

“Can you imagine the cost to these insurance companies to drop all of these plans in the first place?”

Well, not if they managed to bum’s rush and/or snooker all those beneficiaries into more expensive policies. I don’t think they’re going to be able to do that now.

  12. Jim says:

Tina, It’s my guess that they are only dropping people who they don’t want anymore. In other words: older, high risk.

Just watch, Obamacare was only the excuse, they’ll drop them anyway.

  13. Pie Guevara says:

    Re #11 Peggy :

I’d say Piers has a problem too. He threatened to deport himself if 2nd Amendment violating gun laws were not passed.

This was a threat? 😀 If so, an empty one.

  14. Tina says:

Peggy: “Also, state insurance commissioners have the power to decide if their state will participate with this fix. They’re now screaming about the mess Obama just presented them to remedy in just six weeks.”

Yep…this is what I meant when I wrote that he was shifting blame. they tried to blame the insurance companies for the rules in Obamacare that made them drop policies and it didn’t fly. Next year when policies for individuals and business are dropped it will be someone else’s problem…the insurance commissioner did it…I tried to gove you a better plan blah blah blah. But I can’t see how any of this is going to work.

This law’s flaws have and will create a lot of misery for sick people. What a mess.

  15. Libby says:

Ah, Jim … you are forgetting the new rules!

These heinous capitalists are REQUIRED to drop policies (not beneficiaries) that do not meet the requirements of the the ACA.

But if these beneficiaries, old and sick though they may be, want to purchase other policies … as long as they’ve got the cash, they cannot be turned down.

  16. Dewey says:

Insurance companies are the criminals in the situation. Next when someone with a junk policy gets sick and finds out they are not covered will blame Obama Care for the Junk policy they begged to keep. And oh yea there will be completely different post!Hilarious!

I would be worried about the big money donors who have the gov up against the wall and use low IQ Americans as a mouthpiece with false information. less than 10 years to being a communist fascist country if we do not demand a constitutional convention and abolish the Tea Party scam to corporatism and slave workers for China.

And not a word on the TPP yet Eh?

  17. Tina says:

Libby: “In fact, failing to implement and or fund laws we don’t like has long been a speciality of Republican administrations.”

I don’t think you’re ina position to fuss about the fuss. Democrats pretty much owned the congress for about fifty years. History News Network has an example of Democrats trying to withhold funds circa 1975:

What happened when Democrats in Congress cut off funding for the Vietnam War?

Historians have directly attributed the fall of Saigon in 1975 to the cessation of American aid. Without the necessary funds, South Vietnam found it logistically and financially impossible to defeat the North Vietnamese army. Moreover, the withdrawal of aid encouraged North Vietnam to begin an effective military offensive against South Vietnam. Given the monetary and military investment in Vietnam, former Assistant Secretary of State Richard Armitage compared the American withdrawal to “a pregnant lady, abandoned by her lover to face her fate.” (2) Historian Lewis Fanning went so far as to say that “it was not the Hanoi communists who won the war, but rather the American Congress that lost it.”

And how many Vietnamese and Cambodian people lost their lives or were imprisoned and tortured as a result?

2 million in Cambodia were killed and in Vietnam the imprisonment and killing has gone on since…over a million as of 2001.

  18. Pie Guevara says:

Have anyone besides me noticed the more Obama and ObamaCare fails the more vapid and rabid the progressives who frequent this forum become?

  19. Dewey says:

Oh the poor insurance companies and their shareholders!

Now exactly which section and article of the ACA are troubling one?

Since the bill has to have been read to have all this knowledge how about actually reading it and discussing it!

“Some people think”? How about I have read it?

The plan started in the Heritage Foundation and went from there still ignoring that fact?

Romneycare is still doing great, had a slow start and they had to fix a couple things but ya know what it worked!

So I guess maybe the Tea Party should move on to getting rid of vetrens benefits and social security as that is #1 on their current list. Paul Ryan working on that as well!

All tax dollars should go to corporations and the people should pay corporations for everything! have a house fire? Pull out a credit card! You taxes are not for the gov services anymore they are to go to the wealthiest citizens of the US!

What kind of healthcare does Congress have? LOL

  20. Dewey says:

LOL how can a law that is not yet fully in affect be failing?

LOL A website is not a law! LOL

The ACA what is the real problem? reforming Healthcare?

Exactly which part of the bill bothers you guys most? I mean of course you have read it!

The F-word is sure being used a lot tonight on the news and internet.

Is a case building that could prove fraud or even “serial fraud” as McCarthy’s above article states? Sure looks like it especially as was just pointed out it was the Democrats who wrote the ACA bill behind locked doors and on a party-line voted down the Republican bill to fix the grandfather clause.

    —–

Friendly reminder from CNN: Senate Democrats killed a 2010 GOP proposal to let more people keep their plans:
    November 1, 2013

“In September 2010, Senate Republicans brought a resolution to the floor to block implementation of the grandfather rule, warning that it would result in canceled policies and violate President Barack Obama’s promise that people could keep their insurance if they liked it.

“The District of Columbia is an island surrounded by reality. Only in the District of Columbia could you get away with telling the people if you like what you have you can keep it, and then pass regulations six months later that do just the opposite and figure that people are going to ignore it. But common sense is eventually going to prevail in this town and common sense is going to have to prevail on this piece of legislation as well,” Iowa Sen. Chuck Grassley said at the time.

“The administration’s own regulations prove this is not the case. Under the grandfathering regulation, according to the White House’s own economic impact analysis, as many as 69 percent of businesses will lose their grandfathered status by 2013 and be forced to buy government-approved plans,” the Iowa Republican said.

On a party line vote, Democrats killed the resolution, which could come back to haunt vulnerable Democrats up for re-election this year.”

  26. Tina says:

Dewey: “Next when someone with a junk policy gets sick and finds out they are not covered”

I’m inspired to ask how old you are because you definitely need to…

    Grow up!

Anyone buying an insurance policy should know what is in it before he pays the premium.

Insurance: Coverage by a contract binding a party to indemnify another against specified loss (service) in return for premiums paid.

Insurance…the word suggests something purchased for protection against great loss…or set aside in case of emergency.

Bike helmets, purchased for protection, provide some “insurance” against injury…they do not provide a guarantee against injury.

We don’t buy home owners insurance that covers lawn care, pool maintenance, or plunging out a stopped up toilet!

Likewise health insurance was never intended as payment for every hang nail or stomach flu. Policies cover different services and come with differing terms and conditions.

The something for nothing mentality that demands someone else foot the major cost of healthcare is the main thing pushing healthcare costs through the roof. All of the big government bureaucracy is very expensive. Third party payers don’t give a rip about costs because it isn’t their money! When healthcare is “free” people don’t hesitate…if they sneeze they go to the doctor!

If you are against profits then get healthcare insurance from a non-profit provider!

Solve your own life problems…grow up…be a man!

  27. Peggy says:

    #18 Tina,

You and I have both presented the FACT that it was the Democrats who shutdown the Vietnam War by defunding it. The progressives on this site are either blind to the words or so stubborn they refuse to believe what IS our history.

Democrats were almost heroes for stopping the hated Vietnam War that caused the deaths of all of those in Vietnam, Cambodia, Laos, etc. and the tens of thousands of refugees/boat-people we accepted with open arms and pocketbook to provide every one of them with every type of aide we offered.

It was the soldiers who were vilified for trying to save the So. Vietnam people from being taken over by the No. Vietnam communist and not the Democrats in Congress who succeeded in shutting down the war that caused all of those deaths.

Yet today we have just a handful of conservative Republicans who tried to defund ObamaCare AND FUND the country who were/are called every vile name possible including “wacko-birds and terrorist.”

The 50 years the Democrats have held control of Congress has reduced the Republicans to acting like an orphaned child with out a country. It is time for them to grow up and act like adults. They don’t need the approval of the Democrats (parents) for them to do their jobs.

Polls show the majority of Americans do not want ObamaCare just as they did for those who were against the war.
