Last Thursday and Friday two separate judges gave the IRS a deadline to explain themselves regarding the loss of emails:
Sullivan’s decision came on Thursday and it was a shocker. Sullivan ordered the IRS to come back to his courtroom not later than 30 days hence with a signed and sworn affidavit.
That affidavit is to explain in detail how emails to and from former IRS senior executive Lois Lerner concerning targeting of Tea Party and conservative nonprofit applicants were allegedly lost.
Sullivan also ordered lawyers for the IRS and Judicial Watch, which brought the suit at issue in the case, to meet in September before “Magistrate Judge John M. Facciola, an expert in electronic discovery, to determine other avenues to recover the emails,” according to the Washington Examiner’s Mark Flatten.
In the Friday ruling, Walton gave the federal tax agency one week to come back to his courtroom with a signed affidavit explaining why the allegedly lost hard drive on Lerner’s government computer “cannot be identified and preserved.”
Walton also directed that the affidavit explain the qualifications of the IRS inspector general investigators probing the lost hard drive and provide a completion date for their work.
The Walton decree came in a lawsuit filed against the government by True the Vote, one of the Tea Party nonprofit applicants targeted by the IRS for illegal harassment.
The rulings represent a test for our system of checks and balances in a two pronged force, the legislative and judicial branches confronting abuses and cover up by the executive branch.

It will be interesting to see if the IRS complies with both judges’ orders or if it will treat the court with the same disrespect and contempt as the Congress committees.

In unprecedented criticism of the White House, 38 journalism groups have assailed the president’s team for censoring media coverage, limiting access to top officials and overall “politically-driven suppression of the news.”
In a letter to President Obama, the 38, led by the Society of Professional Journalists, said efforts by government officials to stifle or block coverage has grown for years and reached a high-point under his administration despite Obama’s 2008 campaign promise to provide transparency.
Worse, they said: As access for reporters has been cut off, the administration has opened the door to lobbyists, special interests and “people with money.”
And as a result, they wrote, Obama only has himself to blame for the current cynicism of his administration. “You need look no further than your own administration for a major source of that frustration – politically driven suppression of news and information about federal agencies. We call on you to take a stand to stop the spin and let the sunshine in,” wrote David Cuillier, president of SPJ.”
